Lanham Act and Unfair Competition

Raphael Janove created a novel application of the Lanham Act and the law of unfair competition to protect millions of small businesses nationwide. He has successfully achieved final approval of three Lanham Act class actions on behalf of small businesses whose information was unlawfully used by tech companies for their own gain, including against Groupon, ClassPass, and Giftly.com. He also continues to pursue a class action against GiftRocket and Tremendous for falsely claiming to sell gift cards to businesses who did not agree to be listed on GiftRocket.com.

Raphael leverages his Lanham Act knowledge to help small businesses entrepreneurs who are unfairly taken advantage of by their competitors.

Raphael’s Lanham Act cases have been repeatedly covered by Law360 (here and here), Crain’s Chicago Business (here and here), Business Insider (here) Vice (here and here), and a local ABC station (here).

Video Games and Addictive Mobile Apps

Janove PLLC leads class actions and mass arbitrations against mobile app developers for deceptive advertising and manipulation in highly addictive mobile games. Raphael Janove works on behalf of gamers, many of whom have spent enormous amounts of money due to deceptive and unfair practices on these mobile games, including on Warner Bros.’s Game of Thrones: Conquest game and FunPlus’s State of Survival and King of Avalon games.

Vice covered Raphael’s fight against these mobile game developers, in the article, ‘Game of Thrones: Conquest’ and ‘State of Survival’ Players Say They Felt Addicted and Pressured To Spend, available here. These cases have been widely covered by video game news outlets, including, for example Pocket Gamer, Game Developer, Gaming on Phone, Games Industry, and Video Game News 24.

          Data Privacy and Tracking

Janove PLLC pursues class actions and mass arbitrations against tech companies and websites for unlawfully tracking and collecting your private information. Many websites automatically allow third parties to collect a user’s interactions and communications with that website. Unbeknownst to users, they use that information for marketing or share it with other companies.

Individuals may be entitled to significant compensation for a website’s or mobile app’s unlawful recording, tracking, and sharing of an individual’s activity on the website or app. Janove PLLC seeks compensation and to force companies to respect individual privacy.

Beyond seeking financial redress, Janove PLLC endeavors to compel companies to cease their deceptive practices as an integral component of achieving a successful resolution. By holding corporations accountable for their actions, the Firm strives to foster a marketplace where transparency and honesty prevail, ultimately benefiting consumers and promoting fair business practices.

                  Forced Labor and Human Trafficking

Janove PLLC advocates on behalf of immigrants who were forced to work without pay in immigration detention centers. He currently has two class actions on behalf of immigrants who were detained in county detention centers in Illinois and Wisconsin.

While there have been multiple forced labor class actions on behalf of immigrants across the country, they have been brought against private contractors and companies. Raphael Janove was the first to bring this type of lawsuit against a municipal detention center, McHenry County in Illinois, and beat its motion to dismiss. The class action was covered by the Chicago Tribune, the Northwest Herald, and other regional news outlet.

As Raphael explained in an interview for a recent article about forced labor cases, “The issue is simple ... Immigrants aren't slaves and slavery is bad."  The Article is available here.
